June 13, 2016

NAM panel members Richard P. Byrne, Esq., Hon. Peter B. Skelos and Hon. Ira B. Warshawsky have been invited by the firm Forchelli, Curto, Deegan, Schwartz, Mineo & Terrana LLP to participate in a 90-minute CLE panel discussion on Thursday, June 16, 2016. The seminar, entitled “Mediating Construction Defect Claims”, will focus on the use of mediation to settle complex construction claims in lieu of costly and time-consuming litigation.

Construction defect claims often evolve into one of the most complex, expensive, and exasperating types of litigation. Litigating these cases typically involves numerous parties, extensive documentation, never-ending depositions and competing experts. This presentation will provide attorneys with practical tips on resolving these type of claims and will explore logistical issues and challenges, pre-mediation communications, aggregating the parties and their issues, required attendees, pre-mediation submissions and substantive and practical issues and challenges.

Richard Byrne, Esq. has mediated matters involving various areas of the law including construction and commercial disputes, employment discrimination, insurance coverage and property damage claims, risk transfer disputes and disability claims. For the second year in a row, he was voted one of the Top 3 Mediators in the country by The National Law Journal Annual Reader Rankings Survey (2016 and 2015) and named one of 48 2016 Alternative Dispute Resolution Champions in the U.S. by the same publication. Mr. Byrne was also voted one of the Top 10 Mediators by The 2015 New York Law Journal Annual Survey for the second year in a row.
